      Network Management Practices Policy Disclosure

      Company has specific policies and standards regarding our network management practices, performance characteristics, and commercial terms to protect and adequately serve its customers. This information is provided so that Company’s current customers, prospective customers, third-party content providers and other interested parties can make informed choices regarding our Internet access services, and the extent our network management practices may affect those services. Company provides this information not just to meet the requirements under the rules and policies of the Federal Communications Commission, but as a professional standard it works to maintain to best serve our customers.

      Network Management Practices

      The bandwidth and network resources used to deliver our Internet access services are limited and shared among users. In the interest of providing the best online experience possible for all of Company’s customers, Company utilizes reasonable network management practices to respond to situations such as network congestion or excessive users that can unreasonably burden our network and cause service degradation for the majority of users. By engaging in reasonable and responsible network management, Company prevents its customers from being subjected to the negative effects of spam, viruses, security attacks, network congestion, and other risks that threaten to degrade service. The network management practices employed by Company are consistent with industry standards and the rules of the Federal Communications Commission.

      Congestion Management

      It is possible that a relatively small number of customers may place a disproportionate demand on the network bandwidth resources, causing network congestion and an overall degradation in service quality for other end users. For this reason, if Company’s network nears a state of congestion, Company will use congestion management practices to ensure all of Company’s customers retain access to a “fair share” of bandwidth resources. The majority of streaming and downloading – as well as longer-running applications like VoIP, video conferencing and streaming video content – will not exceed the threshold to be eligible for congestion management.
      When Company’s network nears a state of congestion, the congestion management tools, practices and/or software employed by Company will identify segments of the Company network which have a predetermined, aggregated level of bandwidth usage. From there, the congestion management tools will ascertain which customer account in the identified network segment is using a disproportionate share of the bandwidth. The Internet traffic of the identified customer account may be temporarily managed until the period of network congestion passes. Customers whose Internet traffic is temporarily managed by Company will still be able to do anything they want online, and many activities will be unaffected; however, these customers may experience slower downloads and uploads and Internet/website response times. The effects of network management typically will be noticeable only for a brief period of time, if at all.
      Company does not favor, modify, inhibit, rate control or block any specific protocols, protocol ports or fields, or any applications or classes of applications. To the extent that the use of network management practices may affect the performance or other characteristics of Internet service, they are designed to affect all similarly situated customers equally.
      Company has determined that select portions of the network tend to be congested only for small portions of the day, if at all. New network management techniques are constantly being developed on an ongoing basis to address evolving challenges and threats to our network and users.

      Usage Limits

      Company’s Internet service is priced on a flat-fee basis. Company maintains an excessive use policy to address data consumption by customers that is wholly uncharacteristic of a typical user of our network as determined by Company in its sole discretion but which is based on industry standards. Excessive usage is dependent on a number of factors, such as overall usage, the time of day, the number of applications a customer is running, and how congested the local network may be running at that particular time. Company will also monitor the total bandwidth used by a customer on a daily basis and if it exceeds 10 gigabytes, the customer’s download and upload speeds may be compromised for a short period if congestion is determined to be caused to the system by that customer’s usage. However, any such compromises are discontinued by no later than the end of that day and the measurement of usage begins anew the following day. Common activities include numerous or continuous bulk transfers of files and other high capacity traffic using file transfer protocol (“FTP”), peer-to-peer applications, and newsgroups which result in excessive data consumption. Because it is using state-of-the-art technology, a customer’s usage and the response to the system’s needs are both being measured in real time, severely limiting when network congestion techniques must be implemented.

      Device Attachment Rules


      Many devices are approved on our network. In order for a device to be approved for use, the device must conform to publicly available industry standards, including UL certification and FCC Certification, and be non-harmful to Company’s network.




      Company uses industry standard tools and generally accepted best practices and policies to protect our customers from spam, phishing, and other unwanted or harmful online content and activities. In the instances where these tools and policies identify online content as harmful or unwanted, the content may be prevented from reaching customers, or customers may be permitted to identify or inspect content to determine if it is harmful or unwanted. Company conducts several security initiatives by blocking a limited number of ports that are commonly used to send spam, launch malicious attacks, or steal a customers’s information. We limit the number of login, SMTP, DNS, and DHCP transactions per second (at levels far above “normal” rates) that customers can send to our servers in order to protect them from Denial of Service (DoS) attacks.

      Performance Characteristics


      Company offers broadband Internet access service via wireless microwave technology. The advertised speed of Company’s Internet service is the maximum speed achievable with the technology utilized by Company. Actual speeds may vary and are not guaranteed. While the maximum advertised speed is attainable for end users, several factors affect the actual speed of Company’s Internet service offerings, including, but not limited to:


      1. The Customer’s Computer. The end user’s computer, including its age, memory, processing capability, operating system, the number of applications running simultaneously, and the presence of any adware or viruses. All of these factors have an effect on our computer’s ability to communicate with the Internet and can be improved by adding the amount of RAM in your computer and using the most up-to-date operating systems available.
      2. The Customer’s Modem. The connection between a customer’s computer and modem, which can be limited if depending on the model and configuration of the router in addition to the quality of the Ethernet cable and duplex settings of the Ethernet ports on your equipment.
      3. Distance of travel. The distance between a customer’s computer and its final destination on the Internet, including proximity to Company’s transmitting location being accessed by the user, and the number and quality of the networks of various operators in the transmission path as a customer’s connection may traverse multiple providers before reaching its destination.
      4. Many Users on One Site. If there are a large number of visitors accessing a site at the same time, your connection will be affected.
      5. Gating speeds by a website. In order to control traffic or performance, many websites limit the speeds at which a visitor can download from their site.
        Based on internal testing, the peak upload and download speeds are 10 Mbps/4 Mbps during peak usage periods.

      Specialized Services


      The Federal Communications Commission distinguishes between our mass market retail broadband Internet access services and ”specialized services” that share capacity with our broadband Internet access services over our last-mile facilities. Examples of such services may include our Voice over IP phone (“VoIP”) service which shares bandwidth with our Internet access service and because of its nature sometimes receives network priority. It is possible that increased use of our VoIP service may temporarily impact our broadband Internet access service at particular times. However, Company reserves the right to monitor bandwidth, usage, transmissions and content for purposes of protecting the integrity of the network and Company’s Internet access service through reasonable network management practices. Company may collect equipment information to identify the equipment customer is using on the network, including, but not limited to: equipment type, serial number, settings, configuration and software. Company may also collect performance information to examine the operation of the equipment, services and applications the customer may use on the network, including, but not limited to: IP addresses, URLs, data transmission rates and latencies, location information, security characteristics, and information about the amount of bandwidth and other network resources customer is using in connections with uploading, downloading or streaming data to and from the Internet. Network traffic, activity, performance information, and equipment information monitored or collected by Company is done so for the sole purpose of reasonable network management purposes. Company is required to comply with relevant laws, regulations and judicial orders. Information covered under this Privacy Policy, as well as other categories of information, may be disclosed to third parties if Company determines, in its sole discretion, that such a disclosure is necessary or required. Company may also disclose this information if, in its sole discretion, such a disclosure is necessary or required to protect our interests or the interests of our customers. Company may also disclose this information in connection with the sale of our business.
      The Company’s network management practices as discussed herein are intended solely to provide the best online experience possible for all of Company’s customers by safeguarding our network and its users from spam, viruses, phishing, and other unwanted or harmful online content and activities.       You agree that you will use Company’s service strictly to operate your business or commercial enterprise pursuant to the terms of your service Agreement. You may set up one (1) Web page per account for personal use using, but you may not establish a web page using a server located at your business.       If we determine, at our sole discretion, that you are using an excessive amount of bandwidth, we may terminate your account at any time and without notice, or require you to upgrade your service level and pay additional fees in accordance with our Pricing Structure.


      5. NO “SPAMMING”


      You agree that you will not use, nor allow others to use, Company to send unsolicited advertising (including but not limited to mass or bulk e-mail), promotional materials or other forms of solicitation (“spamming”). We reserve the right, in our sole discretion, to determine whether such posting or transmission constitutes an advertisement, promotional material or any other form of solicitation.




      You agree that you will not use, nor allow others to use, Company to send or receive any information which infringes the patents, trademarks, copyrights, trade secrets or proprietary rights of any other person or entity. This includes, but is not limited to digitization of music, movies, photographs or other copyrighted materials or software. Company reserves the right to terminate your account at any time and without notice if it determines that piracy of any protected material has occurred.




      You agree that you will not use, nor allow others to use, Company’s service to disrupt our network or computer equipment owned by other Company customers. You also agree that you will not use, nor allow others to use, Company’s service to disrupt other Internet Service Providers or services, including but not limited to, by e-mail bombing or the use of mass mailing programs.


      8. NO “HACKING”


      You agree that you will not use, nor allow others to use, Company’s service to access the accounts of others or to attempt to penetrate security measures of Company or other computer systems (“hacking”) or to cause a disruption of service to other on-line users. You agree that you will not use, nor allow others to use, tools designed for compromising network security, such as password guessing programs, cracking tools, packet sniffers or network probing tools.




      You agree that you will not use, nor allow others to use, Company’s service to transmit any material that threatens or encourages bodily harm or destruction of property or which harasses, abuses, defames or invades the privacy of any other person or entity.




      You agree that you will not use, nor allow others to use, Company’s service to harm or attempt to harm a minor, including but not limited to, using Company’s service to send pornographic, obscene or profane materials.




      You agree that you will not, nor allow others to, impersonate another user, falsify one’s user name, age or identity in e-mail or in any post or transmission to any newsgroup or mailing list or other similar groups or lists. You agree that you will not, nor allow others to, forge any message header of any electronic transmission, originating or passing through Company’s network.




      You agree that you will not, nor allow others , to post a similar item to more than three (3) newsgroups or mailing lists. You agree that you will not, nor allow others, to post or transmit any private, third party e-mail to any newsgroup or mailing list without the explicit approval of the sender.


      13. NO “VIRUSES”


      You agree that you will not use, nor allow others to use, Company’s service to intentionally transmit computer “viruses, worms, Trojan horses” or other harmful software programs and that you will use your best efforts to prevent the unintentional transmission of such viruses or other harmful software.

      Company reserves the right to terminate your account at any time and without notice if it determines that any such abuse of its system or violation of law has occurred.

      Customer Proprietary Network Information


      This communication is provided in accordance with Department Of Telecommunications. Customer Proprietary Network Information or CPNI is information that Company and other telecommunications carriers obtain when providing your telecommunications services to you. CPNI relates to the quantity, technical configuration, type, destination, location, and amount of use of a telecommunications service, as well as information contained in bills pertaining telephone service.

      We may use your CPNI to offer you additional services of the type you already purchase from us, including products and services, packages, discounts, and promotions. Company does not sell CPNI to unaffiliated third parties.

      If you elect to let Company use confidential service-related information for this purpose, we may also share the information with our Company affiliates, agents, or other related entities for the limited purpose of providing you with the most efficient and beneficial communications services possible and only after confidentiality conditions are in place.
      Company is required by federal law to protect the confidentiality of CPNI. We employ policies and technological security measures to safeguard the CPNI of our customers.
      You have the right to restrict Company’s use of your CPNI. Your decision to restrict our use of CPNI will not affect the service(s) you receive from Company.       Billing Policies and Procedures



      Company bills for services on a calendar month basis, (the 1st through the end of month), for the current month.


      2. PAYMENTS

      Payment for services is due on the 1st day of each month, unless automatic payment is elected. Automatic payments are processed on the 1st of the month for the current month.




      Company offers email invoicing and paper invoicing. Fees for each method are as follows:

      • Email Invoicing – Free
      • Paper Invoicing via Rs.50/month

      Company offers several payment methods. Those methods and the associated fees are as follows:

      • ACH Automatic Payment – Free
      • Credit/Debit Card Automatic Payment – Rs.50/month
      • Online Payment – Rs.50/month
      • UPI – Free

      Walk-in at Local Office – Free – at our office.


      4. LATE FEES

      Customers are assessed a late fee of Rs50/- for outstanding balances not paid by the 10th of the month.


      5. NON-PAYMENT

      Customer accounts with a balance that is more than one month past due may have their service temporarily suspended. Once service is suspended for nonpayment, customers are able to have service reinstated with full payment of the past due balance on the account. For immediate reinstatement of service without Company intervention, customers are able to make a payment using the Company payment portal. Customers may also use one of the other payment methods offered by Company (listed under BILLING METHODS and FEES), but reinstatement could be delayed due to the processing schedule.
      Customer accounts with a balance that is more than two months past due may have their service disconnected. Upon disconnection, the customer must contact the office to restore service. Without payment of the full past due balance and other applicable charges, Company may schedule a technician to recover equipment owned by Company from the customer. Upon disconnect, the customer will be charged for any unrecovered Company equipment and early termination fees, when applicable.



      Payments are non-refundable and there are no refunds or credit for partially used service periods. After the initial term of the agreement is over, the customer may cancel the service for a period up to the last day of the service period prior to cancellation. Cancellation will then be effective at the end of that current billing period. Any request for cancellation after the beginning of a service period will be effective at the end of that service period. If possible, service will continue to be provided at the location ordered or, if the customer moves, to their new location, if it is in a Company service area (subject to any installation charges). If the customer has prepaid for services for any period of time, the service will be considered paid in full and payment is non-refundable. In the event that any check tendered by the customer is returned for any reason, or any credit/debit card or automatic withdrawal from checking or savings, e-check or check-by-phone is declined, Company may assess a fee of Rs. 500.00 to the customer.



      If Company is unable to recover any Company-owned equipment when a customer cancels service, is disconnected for non-payment, or for any other reason, the customer will be billed for all such equipment and collection efforts.
